NOTICE IS HEREBY GIVEN that the resolution published herewith has been adopted by the Town Board of the Town of New Lebanon, Columbia County, New York on the 8th day of October, 2024.  Such resolution was adopted subject to a mandatory referendum held on the 21st day of January, 2025, and was approved at such referendum, and the validity of the obligations authorized by such resolution may be hereafter contested only if such obligations were authorized for an object or purpose for which the Town of New Lebanon is not authorized to expend money or if the provisions of law which should have been complied with as of the date of publication of this notice were not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty (20) days after the date of publication of this notice; or if such obligations were authorized in violation of the provisions of the Constitution of New York.

BOND RESOLUTION DATED OCTOBER 8, 2024

A RESOLUTION AUTHORIZING THE CONSTRUCTION OF APPROXIMATELY 6066 LINEAR FEET OF PEDESTRIAN PATHWAYS ALONG PORTIONS OF US ROUTE 20 AND NYS ROUTE 22, TOGETHER WITH RELATED IMPROVEMENTS FOR PEDESTRIAN ACCESS, DRAINAGE, AND RELOCATION OF CURBS AND UTILITIES, AND INCLUDING RELATED ACQUISITION AND SITE WORK, AT AN ESTIMATED MAXIMUM COST OF $2,499,146 AND WITH A PERIOD OF PROBABLE USEFULNESS OF TEN YEARS, AUTHORIZING THE ISSUANCE OF SERIAL BONDS OF THE TOWN OF NEW LEBANON, COLUMBIA COUNTY, NEW YORK, IN AN AGGREGATE PRINCIPAL AMOUNT NOT TO EXCEED $499,830 PURSUANT TO THE LOCAL FINANCE LAW TO FINANCE A PORTION OF THE COST THEREOF, AND APPLICATION OF PROCEEDS OF A NYS DOT TAP GRANT IN THE AMOUNT OF UP TO $1,999,316 TO PAY OR REIMBURSE A PORTION OF THE COST THEREOF, DELEGATING CERTAIN POWERS IN CONNECTION THEREWITH TO THE TOWN SUPERVISOR

            Objects or purposes: The Bond Resolution authorizes the construction of approximately 6066 linear feet of pedestrian pathways along portions of US Route 20 and NYS Route 22, together with related improvements for pedestrian access, drainage, and relocation of curbs and utilities, and including related acquisition and site work, at an estimated maximum cost of $2,499,146. The aforesaid purpose constitutes an unlisted action as defined under the State Environmental Quality Review Regulations, 6 NYCRR Part 617, which has been determined under SEQRA not to have a significant impact on the environment.

            Period of Probable Usefulness: Ten (10) years, pursuant to subdivision 90 of paragraph a of Section 11.00 of the Local Finance Law.  The obligations authorized by the Bond Resolution will be in excess of five years from the original date of issuance of such obligations.

            Maximum Amount of Obligations to be issued: The Town Board plans to finance a portion of the cost of said purpose by the issuance of serial bonds of the Town in an amount not to exceed $499,830.  A portion of the project cost is expected to be paid or reimbursed from the proceeds of a NYS Department of Transportation TAP grant in the amount of up to $1,999,316.

Delegation: The power to authorize bond anticipation notes in anticipation of the issuance of the serial bonds authorized by this resolution, determine the form and terms of said serial bonds, and take certain other actions is delegated to the Town Supervisor, as Chief Fiscal Officer.
